In my last Tyler, TX real estate blog post, I began a discussion of the various duties home buyers and sellers should expect from your Tyler real estate agent. But what does that mean? Tyler real estate agents must create the habit of obeying their principal. It’s defined as a “dutiful compliance with a command, prohibition, or known law and rule prescribed; submission to authority”. That means you, the home buying and selling client are in authority over your agent. It’s at this point I need to remind you, “I’m not an attorney nor do I practice law”. The actions of any agent engaged in transacting real estate in the state of Texas must abide by the law and the “law of agency” passed by our legislature and governed by the Texas Real Estate Commission. The point being, don’t expect your Tyler real estate agent to break the law to obey your wishes. You actually place yourself in legal jeopardy if you do.

Disclosure of Information by Your Tyler, TX REALTOR®

This means your agent must make a full disclosure of all facts pertaining to a Tyler, TX real estate transaction. The disclosure must be prompt and it must be within your agents knowledge. Where this disclosure commonly comes into play is with zoning issues, and regarding any knowledge that may impact Tyler, TX property values. It even means when an agent offers their “opinion” to the advantages and disadvantages to any offer.

Mention the word and the first thing that comes to mind is managing funds… your money. Plain and simple, the laws of the Texas Real Estate Commission expect licensed real estate agents to maintain accurate records of every transaction we participate in on behalf of our home buyers and home sellers.
